Terms of Use

Effective date: September 30, 2026

These Terms of Use ("Terms") are an agreement between you and Fitdrip ("Fitdrip," "we," "us," or "our"), operated by Fitrip (Jermell Lewis) in Ontario, Canada. They govern your use of fitdrip.co and its features, including the directory, FitDrip AI, and paid plans (together, the "Service").

1. Acceptance

By accessing or using the Service, creating an account, or buying a plan, you agree to these Terms and to our [Privacy Policy](/privacy). If you do not agree, do not use the Service. If you use the Service on behalf of a business, you confirm you are authorized to accept these Terms for that business, and "you" includes the business.

2. Eligibility

You must be able to form a binding contract under the laws that apply to you. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or guardian. The Service is not directed at children under 13, and children under 13 may not create accounts.

3. Accounts

Sign-in is provided through Manus (manus.im), and your use of Manus is also subject to its terms. You are responsible for keeping your login secure, for the accuracy of your account information, and for activity under your account. Tell us promptly at fitdripai@gmail.com if you suspect unauthorized use.

4. Directory content: accuracy and no endorsement

Fitdrip is a directory of gyms, spas, coaches, events, brands, and other businesses. Please understand that:

• Some listings are imported from third-party sources, publicly available sources, or information provided by users, and some listing content is prepared with the help of AI tools.
• Listings may be incomplete, inaccurate, or out of date, and are unverified until claimed by the business. Even claimed listings are provided by the business, and we do not verify every detail.
• A listing, ranking, or placement is not an endorsement, recommendation, or guarantee of any business, person, product, service, credential, price, or event.
• "Featured" and other promoted labels (including Pro and Strategic Partnership placements) mean the business paid for placement or visibility. They do not mean we have reviewed or endorse the business.

Always confirm important details (such as hours, prices, qualifications, and safety practices) directly with the business before relying on them. Your dealings with any listed business are solely between you and that business.

5. Claiming, editing, and removing listings

• Claim: A business can claim its listing using the claim form, providing a business email and the reason it is authorized to manage the listing.
• Edit or remove: A business, or a person named in a listing, can request a correction or removal by emailing fitdripai@gmail.com with the listing URL and the requested change.
• Verification: We may ask for information to confirm your identity or your authority over the business, and we may decline requests we cannot verify.
• Response: We aim to respond within 5 business days. This is a target, not a promise. We may accept, modify, or decline requests at our reasonable discretion, subject to applicable law.

6. Your content and license to us

"Your Content" means anything you submit to the Service, such as listing details, descriptions, photos, logos, claim information, messages, and AI prompts. You keep any ownership rights you have in Your Content.

You grant Fitdrip a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, copy, format, adapt, translate, display, and distribute Your Content to operate, improve, and promote the Service. For business listings, this license continues for as long as the content is on the Service and for a reasonable time afterward to remove it from active systems and backups.

You confirm that you have the rights needed to submit Your Content, that it is accurate, and that it does not violate the law or anyone's rights. We may edit, refuse, or remove any content at our discretion.

7. Acceptable use

You agree not to:

• scrape, crawl, harvest, or bulk-download listings or other content, or use automated tools to access the Service, without our written permission;
• copy or republish the directory, or use it to build a competing database;
• submit false, misleading, defamatory, infringing, or unlawful content, or impersonate any person or business;
• claim or edit a listing you are not authorized to manage;
• use the Service to send spam or unsolicited messages to listed businesses or individuals;
• interfere with, overload, probe, or bypass the security of the Service, or introduce malware;
• manipulate rankings, ads, analytics, or AI credits, or click on ads fraudulently;
• use FitDrip AI to generate unlawful, harmful, or abusive content, or attempt to extract its underlying systems or prompts; or
• break any law or violate anyone's rights.

8. FitDrip AI

• What it is: FitDrip AI (fitdrip.co/ai) uses artificial intelligence to answer questions and suggest listings.
• Plans and credits: Use of FitDrip AI consumes credits. The Free tier includes a limited number of credits, and the paid Fitdrip+ subscription includes additional credits or features, as described on the site at the time. Credit amounts, renewal, and expiry are as described in your plan details on the site.
• Credits have no cash value. They cannot be sold, transferred, or exchanged for money, and are not refundable except where required by law. Credits may expire, and we may change credit amounts, pricing, or features with notice as described in section 9.
• Output may be wrong. AI output can be inaccurate, incomplete, out of date, or inappropriate, and may describe businesses incorrectly. Verify anything important.
• Not professional advice. FitDrip AI and all content on the Service are for general information only and are not medical, health, nutrition, fitness, legal, or financial advice. Consult a qualified professional, such as a physician, before starting any exercise, nutrition, or recovery program, especially if you have a health condition or injury.
• Assumption of risk. Physical activity, training, sports, spa and recovery treatments, and events carry inherent risks of injury. If you choose to take part in any activity or use any business found through the Service, you do so voluntarily and at your own risk, to the extent permitted by law.

9. Paid plans and subscriptions

Plans. We offer paid plans that may include Fitdrip+ (for FitDrip AI), and for businesses: Pro (CA$37/month), Featured (CA$397/month), and Strategic Partnerships (custom pricing). Current features and prices are shown on the site and at checkout. All prices are in Canadian dollars (CA$) unless stated otherwise.

Payment. Checkout is handled by our external third-party payment processor (name to be confirmed), and is subject to its terms. You authorize us and the processor to charge your payment method for the plan you choose.

Automatic renewal. Subscriptions renew automatically at the end of each billing period (for example, monthly) at the then-current price, and your payment method will be charged unless you cancel before the renewal date.

Cancellation. You can cancel at any time by emailing fitdripai@gmail.com from the email address on your account. Cancellation takes effect at the end of your current billing period, and you keep access until then.

Refunds. Purchases of advertising, including Featured listings and similar paid placements or promotions, are non-refundable once purchased, and we do not give refunds or credits for partial billing periods or unused time, except where required by law. You can cancel at any time, and after you cancel, your listing, placement, or subscription will not renew; it stays active until the end of the period you already paid for. Nothing in these Terms limits any refund or cancellation rights you have under applicable consumer protection law.

Taxes. Prices may not include applicable taxes (such as GST/HST), which will be added where required.

Price changes. We may change prices or plan features. We will give you at least 30 days' notice before a price change applies to your subscription, and you may cancel before it takes effect.

Failed payments. If a payment fails, we may suspend or downgrade the paid features until payment is made.

10. Pro, Featured, and partnership placements

Paid placements increase visibility on the Service but we do not guarantee any results, including traffic, impressions, clicks, leads, bookings, sales, or ranking position. Placement location, design, and availability may change. Advertisers and businesses are responsible for their content and for complying with laws, including advertising and consumer protection laws. We may reject, pause, or remove any placement that we reasonably believe violates these Terms or the law. Strategic Partnerships may be subject to a separate written agreement, which will control if it conflicts with these Terms.

11. Third-party links and ads

The Service includes links to third-party websites and businesses and displays third-party ads, including through Google AdSense. We do not control and are not responsible for third-party sites, ads, products, or services, or for their privacy practices. Using them is at your own risk and subject to their terms.

12. Intellectual property and trademarks

The Service, including its design, software, text, graphics, and compilation of content (excluding Your Content and third-party content), is owned by Fitdrip or its licensors and protected by law. We give you a limited, personal, non-exclusive, revocable right to use the Service for its intended purpose under these Terms.

FITDRIP, FitDrip AI, Fitdrip+, and related logos are trademarks of Fitdrip. These are unregistered trademarks; you may not use them without our written permission. Other names and logos on the Service belong to their respective owners, and their appearance does not imply affiliation or endorsement.

13. Copyright complaints

If you believe content on the Service infringes your copyright, email fitdripai@gmail.com with: your contact details; a description of the work; the URL of the material; a statement that you believe in good faith that the use is not authorized; a statement that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We will review notices and may remove material or forward the notice to the person who posted it, as permitted or required by law.

14. Disclaimers

To the fullest extent permitted by law, the Service, listings, AI output, and all content are provided "as is" and "as available", without warranties or conditions of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, availability, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

15. Limitation of liability

To the fullest extent permitted by law:

• Fitdrip and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to the Service, any listing, any AI output, or any business or activity you find through the Service.
• Our total liability for any claim relating to the Service will not exceed the total amount you paid to Fitdrip in the 12 months before the event giving rise to the claim.

Some laws, including Ontario consumer protection law, do not allow certain warranties, conditions, or liabilities to be excluded or limited. Nothing in these Terms excludes or limits any right or liability that cannot be excluded or limited under applicable law, and the limits above apply only to the extent permitted.

16. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Fitdrip and its operator from claims, losses, and expenses (including reasonable legal fees) arising from Your Content, your misuse of the Service, or your violation of these Terms or of anyone's rights.

17. Suspension and termination

You may stop using the Service at any time and may cancel paid plans as described in section 9. We may suspend or end your access, or remove content or listings, if you violate these Terms, if required by law, or to protect the Service or others. We may also change or discontinue features. Sections that by their nature should survive (including sections 6, 12, and 14–19) survive termination.

18. Governing law and courts

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. Subject to any non-waivable rights you have as a consumer, you and Fitdrip agree to the exclusive jurisdiction of the courts of Ontario.

19. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and change the effective date. For significant changes, we will give additional notice, such as a site notice or email. If you continue to use the Service after the changes take effect, the updated Terms apply. If you do not agree, stop using the Service and cancel any paid plan.

20. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver. You may not transfer these Terms without our consent; we may transfer them in connection with a sale or reorganization of Fitdrip. These Terms, together with the Privacy Policy and any order or partnership agreement, are the entire agreement between you and us about the Service.
